Sri Lanka looks to be deteriorating - both President and PM are resigning. I've given it some thought and here's one possible outcome.

Sri Lanka's president has resigned after fleeing the country and the government has all but collapsed. Best case guesses are maybe 6 months to maybe sorta get things back to normal.
In the face of enormous riots, unrest, and the beginnings of a mass famine, international aid is extended. People aren't stupid - they see that neither China nor India is doing this out of the goodness of their hearts. Both offers are accepted by different factions, resulting in a Chinese airbase being built and a heavy garrison of Indian troops stationed. On the very, very optimistic assumption that Democrats would do anything with it (lol no they wouldn't, the campaign donors won't let them) we don't have 50 or 60 years to vote for nice, polite solutions in the marketplace of ideas to build institutions that can work towards fixing these kinds of problems within the boundaries of the system.

Twitter has Musk over a barrel. They’re suing for specific performance because the contract Musk wrote has that as the penalty for breach.

The $1bn in liquidated damages only occurs if he cannot get financing. He already has financing. Banks have issued the bonds. He has to put in more personally than he originally intended, but he has the money.

The Delaware court of chancery is built upon the provision that clear and unambiguous contractual terms will be enforced. If a judge started ignoring terms or rewriting contracts, one of the biggest reasons everyone is incorporated in Delaware disappears.

Musk may not be forced to buy Twitter by the court, but that only happens if they settle first. The settlement price right now is around $16-17b which is the difference in current share price and what Musk offered.

The complaint from Twitter is very well written and is easy for a layperson to read. The judge in this case doesn’t gently caress around, and, earlier this year, has ordered specific performance when a buyer attempted to use bad faith tactics to tank the deal.

This court also moves fast. There will be resolution by October - either Musk will own Twitter or Twitter will be paying a hell of a dividend to shareholders.

Twitter is very clearly in the right from a contractual standpoint. A contract was negotiated, the terms were clear, the contract was signed. Perfomance is due.
