well I decided to look into this issue a bit further https://www.cpr.org/2022/02/15/prisoners-allege-forced-labor-violates-states-anti-slavery-law/ it appears that what happens is you get the anti slavery law on the books, the work programs remain, and the courts have to figure out if the law actually applies to prison labor
