There's not much to say, because we don't have that much data. From what has been exposed, this is manslaughter if not murder. At minimum, any officer dumb enough to shoot across his partner's lap at a non-threatening member of the public is a disgrace to his profession and honestly did not have the temperment to have ever been carrying a gun in the public trust in the first place. However, the shooter is refusing (via his lawyer) to make a statement to investigators, and there weren't any witnesses other than those involved.
