I think you're confused. Evans wasn't on trial for sneaking into a threesome without the victim knowing. The question in the trial was whether the victim could have consented to sex with both men, and the testified to having no recollection of the night. If the jury concluded that the victim wasn't credible and consented to sex with Macdonald, they should have reached the same conclusion with Evans. E: this was at stickfngrdboy Double edit: the jury didnt have to conclude that the victim had consensual sex with Macdonald, but that doesn't change my reasoning.
