The legislature loves to extra-enhance malum in se crimes that happen near schools, parks, daycares and churches.

It's the court's conservatives safely grumping about not getting an en banc hearing on a moot issue. It certainly signals the direction that judicial support for Ban II will come from, though, but err already knew that.
