Crucially, Gant can't testify. He hasn't said anything that we can cross-examine, after all. His only defense has been to present evidence, or in this case, to browbeat Phoenix into presenting the evidence on his behalf.

I think him admitting to arranging the crime scene before Lana found it would count as testimony (though we're not cross-examining it), but that just means Wrighto/Worthy/Udgey have the right to tell him to shut up. I don't think they're obligated to do so, though, and at least two of them realize he's digging his own grave.

Part 163: Episode 5, Final Day, Trial Latter 2: Phase Three

This picture is the key, as I explained when we first got it. (Interesting note: We did get a fourth page of evidence when we got that picture.)

And what exactly is this supposed to be...?
Sound: Realization

This is the picture Ms. Skye took.

Take a good look at it.

Sound: Wipe

Yes... His shirt is showing underneath.

Oh! But that piece of cloth...

The judge is getting salty with that penalty.

Music: Suspense

(What am I doing!?)

(If this cloth was cut from Prosecutor Marshall's vest after he died...)

(Then something's definitely not right about it!)

It's too late to turn back now.

You're the only one who can put an end to this, Wright!

(Chief Gant, your tyrannical reign ends here!)

Behold! The piece of evidence that contradicts this cloth!

And we're back at the evidence list!

Music: Silence

Since Ema Skye's fingerprints are on this cloth,

there's no doubt that she shoved the prosecutor aside!

However!

Now then, Chief Gant.

You do have some conclusive evidence, don't you?

Ah well, at least it was short this time. So the argument is because we refused to present it initially, we can't use it later? Seems like another conveniently made-up rule...

Well, that's true...

The defense did refuse to present evidence!

I'm afraid Mr. Gant's claim is legally correct.

Well, Mr. Edgeworth?

There's an interesting disinction being made here. Are we trying to convict Gant here? I thought we were more just proving that someone else did it to get our own client off the hook, but maybe these trials have been resulting in direct convictions of the actual killers rather than them getting their own trials? Or is the point that if we can't use the evidence to convict Gant in his own trial, we can't use it to prove Lana's innocence in this trial?

assuming, of course, that the evidence is indeed illegal.
Sound: Realization

Hmm?

Well, Mr. Wright?

...

Music: Suspense

(It seems... at last...)

Sound: Wipe

Sure, this was your plan all along...

Mr. Wright.

Do you admit to it?

Tricky wording here. We did conceal the cloth on purpose, but did we do so illegally? I don't think so.

I admit I refused to present it at one point.

quote:

If we say "I did" instead...

(No! If I admit to that...)

(all my planning will have been for nothing!)
Sound: Stab

It seems...

Mr. Wright didn't understand the implication of his conduct.
Sound: Damage 2

There's that penalty.

If you're going to change your position,

this is your only chance, Wright!

(He's right...)

I admit I refused to present it at one point.

From there, we continue the same as the other option, which just skips the penalty and the scene associated with it.

Sound: Drama Pound

No it isn't, Mr. Gant.

It's funny, if Gant hadn't been in such a rush to cover his rear end, he would have realized he should have waited until after he skewered the cowboy to cut the cloth out, so that the blood would have soaked that part as well. That would have made it impossible to prove he was the murderer without corroborating evidence or testimony.

Sound: Light Bulb

No...

He's right.

At the beginning of today's trial,

The elegance of this plan hinges on Phoenix's exact wording the first time he refused to show the cloth: "I don't have any evidence I can present at this point in time." Meaning, he does have evidence, but he can't show it! I take back my snark on that flashback last update, it was a good way to foreshadow/hint at this point and I missed it both when the line was originally said and in the flashback.

Things were on a path to spin out really well for Gant. Get even more pressure on Lana, even more suspicion on Edgeworth.

But these bits where it turns out to have been mostly spur-of-the-moment choices on Gant's part feel unsatisfying to me - for the second murder, but even more for the first:

Gant comes upon Neil Marshall's unconscious body, and just decides to murder him, because he figures he can use the situation to blackmail Lana from here on. It feels like there's something missing for him to take such a drastic action, and I feel like it would've been easy to fill it in:

What if Gant had committed a murder already around the time Joe Darke was apprehended, say killing someone to make a case or hide that he'd manipulated evidence. During the interrogation of Darke, Gant starts pushing Darke to confess to the murder Gant committed as well, to get the scent off him. What's one more murder attributed to a serial killer? Marshall starts arguing with Gant, not playing ball and asking questions. As they argue, Darke is panicking because he's set up to take the fall for one murder he didn't commit, and makes a break for it. Marshall tells Gant "we'll talk about this later", and they pursue Darke, Gant now panicking himself because Marshall might figure out Gant is responsible for a murder, and so he has a motive to kill Marshall when an opportunity presents itself.

Sorry for the fanfic, I suppose it's already too long a case as it is. But this one in particular feels like it got re-written so many times, some points got lost in the edit.

Interesting, I hadn't considered that angle. Still, I feel like it misses something. Murdering a prosecutor just to get a conviction is extreme, and why did he need leverage on Lana to begin with, really? Or was it their respective roles in law enforcement? The chief wants convictions, so he forces his prosecutor Lana to... prosecute despite flimsy evidence? Meh.
