This could be mitigated with proper documentation procedures, however many doctors don't believe in those (famously, surgeons still widely reject the pre-procedure "check list", which is exactly what you think it is).

Breaking an NDA or using a bit of social engineering to get yourself an interview is one thing, but perjuring yourself in your state and federal filings so that you can back false credentials should probably not be OK. Likewise for violating the federal wire tap statute, that would mean they were recording communications to which they weren't a party. And as far as the NDA, well, whether or not you're morally in the right, probably time to take your lumps if you sign one to get confidential info that you're going to publish.

That's also true as hell - that's honestly why I thought they hadn't filed a suit yet. I imagine this lawsuit is the result of major consultations with lawyers and this is the only path to restitution that they can see. I just don't see them getting a judgment here beyond maaaaybe a slap on the wrist.
