Washington State has an even wider-ranging response which Fahy patterns herself partially on, but she might be attempting to do this piecemeal because Cuomo isn't taking lead on this and she wants something she can pass relatively quickly.

I'm not a lawyer, but I think Fahy's proposal does not get preempted in this way. New York State would not be preventing ISP's from providing internet access service - it would just bar ISP's that do not abide by certain standards from being eligible for state contracts. So Spectrum (Charter + TWC) could provide whatever closed-off fast-lane bullshit they wanted to private citizens, if they were willing to give up NYS as a potential client.

Spoiler alert: NYS is a BIG client.

Would that affect companies that provide internet fast lanes anywhere or just to people living in NYS? If TWC creates fast lanes for montana residents only are they allowed NYS contracts? I'm wondering how much reach they have.

The phrase is "second most powerful executive" and it isn't meant to refer to the total influence the mayor has, just the relative amount of power it has in the city in comparison to what other executive offices have in their jurisdictions. Mostly the mayor is powerful because of the size and scope of the bureaucracy he leads, which rivals or surpasses most U.S. state governments.

donovan, king, and zedlin have plausible deniability by voting against the tax hike, but it would be lunacy to not implicate them anyway. i have no idea if anyone is running against the long island GOP contingency but the only dem challenging donovan that looks any good is a prop worker for tv shows. everyone else is a cop or a veteran
