I'm not a lawyer, but I think Fahy's proposal does not get preempted in this way. New York State would not be preventing ISP's from providing internet access service - it would just bar ISP's that do not abide by certain standards from being eligible for state contracts. So Spectrum (Charter + TWC) could provide whatever closed-off fast-lane bullshit they wanted to private citizens, if they were willing to give up NYS as a potential client. Spoiler alert: NYS is a BIG client.
