Sarsapariller posted:I think that people in here have a lot looser grasp on law than they might indicate, which is leading them to go with whatever sounds plausible at the moment. CIG released a strongly worded rebuttal of the original claims and a lot of people don't want to be caught out by saying "Oh Crytek's case totally has merit" and then having the whole thing thrown out of court, so they are hedging their bets by kind of gesturing at the possibility that CIG might be in the right. In another couple weeks Skadden will probably issue some kind of counter-statement and then the pendulum will swing back. Thank you. From your response, and the others, it seems like I haven't missed any massive, CryTek-killing bombshell, which is what I was wondering about. There seemed to be a sudden shift in tone, and I thought perhaps something really significant had come along to throw a monkey wrench into CryTek's plan. Hav posted:So, you asked, and technically they can't actually stop me, but it's a contract dispute probably going to jury trial, so nobody _really_ knows. The GLA is a portion of the entire suit, and there's other things that will come up. Personally, I think the claim of two games/one game could come down to a misunderstanding, but that's why 'intentional' was used. CiG appear to be doubling down in terms of the full-throated denial, but that's not unusual. Oh, yeah. I'm looking forward to this, no matter which way it ends up going. I'm just trying to reset my expectations. Sandweed posted:They probably have a strong case because CIG is incompetent, but on the other hand they are a failing company that just launched their own crypto currency so it might just be a last reaching cash grab. I think a cash-grab seems unlikely. I think CryTek probably believes they have a pretty solid claim or claims. Based on nothing but what I've picked up following this saga for the last couple of years, I would be shocked if CIG hadn't hosed up in some actionable way. They're like the modern space-game version of The Gang Who Couldn't Shoot Straight. AngusPodgorny posted:Unless Crytek comes up with something novel in their response, I think CIG has the stronger side on exclusivity and use of Cryengine in Squadron 42, but their damage limitation argument is garbage. Since neither side is paying me, I don't care enough to actually argue about it or research anything though. I doubt anything will happen with the current motion because the judge can put off doing anything until later. I hope you're wrong and it turns out that the "two games" thing is proven to be a willful dodge, because that's the most entertaining option from where I'm sitting.

Chalks posted:At least, they would have a very strong position if it wasn't for another vital part of the contract that Crytek didn't mention directly in their original filing, and CIG appear to have completely overlooked in their MtD. It states that CIG are forbidden from working with any Crytek competitor for the duration of the agreement and for 2 years after its termination. CIG are absolutely in violation of this clause and it looks like such a slam dunk that it's unlikely that Crytek's lawyers missed it. More likely, they were intentionally using a weaker clause as bait for CIG's lawyers to file a half arsed motion to dismiss without fully reviewing the contract. If this is accurate, it's very funny, and makes me hopeful once again that we'll get to see CIG flail helplessly while they try to backpedal around that issue.
