That's just asinine. I think there are some legit issues in Missouri outside of this one case.

Ps. It's also a misstatement of the fifth amendment, as video is not testimonial.

My mistake, Roorda just made the public statements supporting the lawyer's arguments.
Because the internet is better than my memory

quote:

There was nothing life or death about the decision Rory Bruce made to pound this cuffed teenager in custody. Yet, he was acquitted by Associate Circuit Court Judge Theresa Counts Burke. Not because she found this conduct acceptable, but because she never watched the video.

"Prosecutors had also tried, but failed, to get the teenager on the stand. First they couldn’t find him, then when they did, he asserted his Fifth Amendment right against self-incrimination.

But the video never made it into evidence because the law required prosecutors to authenticate it with someone who had personal knowledge of the events. Bruce refused to testify against himself, on the same constitutional grounds as the teen."

The camera's footage has to be verified by someone at the scene, and that was the subject of the fifth amendment claim.

Which is also asinine.

quote:

Roorda says the judge did right—he told News 4, police videos like these should be used to protect police. "Now, it’s become a “gotcha-head hunter” tool that we’ve seen internal affairs go over-board with."

"Police officers have to make split second decisions in life and death situations and I don't think that folks over at the Circuit Attorney's office or folks up in Internal Affairs should second guess them based on their brief impression of a video tape," says Jeff Roorda with the SLPOA. "It doesn't tell the whole story," he says.

I think we've got our explanation

Remember that E-2 who had to be ordered to bathe, who you'd find curled up under some machinery sucking his thumb? The one who you didn't have enough on to process out but you prayed you could keep him away from firearms?

Well, Cleveland gave him a gun and badge.

quote:

A Nov. 29, 2012 letter contained in Tim Loehmann's personnel file from the Independence Police Department says that during firearms qualification training he was "distracted" and "weepy."

"He could not follow simple directions, could not communicate clear thoughts nor recollections, and his handgun performance was dismal," according to the letter written by Deputy Chief Jim Polak of the Independence police.

In an interview with the Northeast Ohio Media Group, Loehmann's father said that his son left Independence to pursue a job with Cleveland police because he wanted "more action."

Loehmann told Tinnirello that he cried often about his personal issue during training and Loehmann's mother told Tinnierello that her son's study papers "would be soaked in tears nightly for three months."

On Nov. 26, 2012, Loehmann was ordered to stay in the Independence police dispatch center. Loehmann left without authorization and lied to Tinnierello that the dispatchers told him he could leave, the letter says.

Loehmann eventually admitted to lying.

The problems at Independence erupted on Nov. 28, 2012, the records say. Loehmann showed up "sleepy and upset" for a 6 a.m. state gun qualification session.

Tinnierello wrote that Loehmann "was distracted and was not following simple instructions" at the shooting range.

At one point, he went to the back of the range to reload his magazine and could not return to the line where he was supposed to shoot from, Tinnierello wrote. Loehmann appeared to be crying and was emotionally upset so Tinnierello said they would stop the exercise for the day.

Some Butte, Montana wannabe thugs picked the wrong house...

http://empirenews.net/bin-laden-shooter-rob-oneill-mistakenly-attacked-by-street-thugs-seeking-to-collect-debt-from-neighbor/

Robert O’Neill, the former United States Navy SEAL who shot and killed Osama Bin Laden, had his home mistakenly invaded by members of a street gang this morning shortly after 1AM. O’Neill was uninjured, the five intruders all suffered injuries and remain hospitalized, but are expected to make a full recovery. Their names were not released in anticipation of the oncoming media storm.

Butte Police Commissioner Bartholomew S. Harrington told members of the Associated Press in a brief press conference that the five men, part of a local street gang connected with the infamous Crips, were seeking to collect on a drug debt and invaded the wrong house, with the intended target just so happening to be the next door neighbor of O’Neill’s.

“Mr. O’Neill had just turned in for the night, but was awoken by a loud crash when his backdoor was abruptly kicked in. As the five thugs ran aimlessly through the home, Mr. O’Neill used silent hand-to-hand combat tactics to individually disarm them of their weapons. Once Mr. O’Neill had taken down the five men and secured his home, he brewed a pot of coffee and called the police station. Those boys sure did find the wrong house!” commissioner Harrington said as he chuckled.

O’Neill had little to say on the matter when Butte Daily Times journalist Kevin Williamson interviewed the celebrated war hero.

“It was nothing really. Those kids didn’t have their mission planned out properly and hit the wrong target. I hated to break their wrists and dislocate each of their knees like I did, but it was necessary in order to immobilize the invasion. I hope they get the money that is owed to them once they get out of jail and decide to live better lives. My main concern is getting my back door fixed. Those boys really did a number on the door jamb,” O’Neill stated.

The neighbor who was the intended target seems to have abandoned home and has not been found by police. According to the men in custody, the debt was over a $50 bag of marijuana.
