If they'd co-operated with discovery, apologised convincingly and made a focused and coherent free speech argument there's excellent odds they'd have gotten away with a succesful defence. Of course the point is a rational Infowars/Alex Jones, who were capable of such behaviour, would never have done the things that required such a defence.
