It's been a while since I listened to those KF episodes, but wasn't he actually pretty subdued when testifying for the deposition. I recall mostly a lot of sighing, clumsy evasion and zero actual fireworks.

If they'd co-operated with discovery, apologised convincingly and made a focused and coherent free speech argument there's excellent odds they'd have gotten away with a succesful defence.

Of course the point is a rational Infowars/Alex Jones, who were capable of such behaviour, would never have done the things that required such a defence.

It did, but I believe it was from an email that was sent to Infowars and the evidence was that email hadn't even been opened by them. Infowars had no idea it was there until it was found by the Plaintiffs examining what deposition was turned over.

So loathe as I am to defend them, not actually Infowars fault.
