Generally (again, generally) to create/join an HOA you file a declaration with the deed records that all the homeowners sign off on, and it runs with the land. And they're necessary in communities where people want them and want a general community plan and standards. If your options are to buy a $300k home in a neighborhood where people can put junked out cars in their yard, and paint their house neon, or buy the same house in a neighborhood where people have to keep their lawn mowed and their houses looking nice, most people want the latter, and are willing to follow the same rules to have that.
