Yeah, so that whole thing is going to be reduced down to 'fired with cause' on an unemployment application and it'll be denied.
Rules vary by state, but everywhere I've looked if your action wasn't chronic, intentional or severe then you're fine.

Examples of discharges that could potentially make an applicant ineligible are:

Continued, unexcused absences and/or tardiness
Using drugs or alcohol on the job
Breaking company rules
Intentional neglect of duties
Insubordination, theft, fighting, or harassment

Examples of discharges that probably won't make an applicant ineligible include:

Absence because of illness or injury with proper notice to the employer
Inability to meet the employer's performance standards
Ordinary errors or accidents not due to carelessness or negligence
Inefficiency
Honest mistakes or omissions
Unless his failure to clock in/out properly was chronic or clearly intentional, then it's just an honest mistake and he should be entitled to unemployment.

#Q9: CAN I DRAW BENEFITS EVEN IF I WAS FIRED?

A: That depends on why you were fired.

If you were fired for Gross Misconduct, then you are disqualified until you return to work for 30 days. Gross misconduct includes being intoxicated on the job, physical violence, and violating prior written warnings.

However, if you were fired for Simple Misconduct, then you are disqualified only for six weeks. Simple misconduct includes absenteeism (missing long periods of work without a good excuse) and insubordination (willfully refusing to perform a standard job duty). In general, Simple Misconduct is defined as violating known rules or willfully disregarding the employer's reasonable interests.

Minor mistakes and accidents do NOT count as misconduct, simple or gross. Not doing the job fast enough, or good enough, does NOT count as misconduct. Even if you've had a written warning that you need to work faster, or better.
I can't imagine there are any states where minor mistakes are cause for ineligibility.

But if you owe me money and I take something of yours to hold until you pay me, that's totally illegal. How is it different in this case? You can't just take someone's stuff because you say they owe you money.

Again, why does this apply in this specific case when it doesn't apply generally?

If I let you park in my driveway I'm still not allowed to take your car though. That's still theft.
They aren't just taking someone's stuff, they are holding it as a lien and technically the object was left with them. And yes, this does apply generally. Parking lots are probably the most common example: It's private property and they are letting you park there if you follow their rules. If you don't (such as parking in a store's lot and then going somewhere completely different for an extended period of time) then you are trespassing and they can tow your car. If you let someone park in your driveway you could have them towed if you felt like being a huge dick.

They wouldn't be paying you, they owe the towing company for the 'service' of having the car towed.

Edit: I guess I should add that you can't just hold someone's car hostage for no reason, but if they owed you, you might. An example would be a car repair shop: They can hold your car against the money owed for repairs. They can also charge storage fees if you don't pick up the car in a reasonable amount of time (generally a few days, they have to try notifying you, and they have to have the rates posted). If a vehicle has been abandoned on your property for a month or two you can sell it at public auction (as long as you've followed the long list of legal steps correctly).

You need to have a reason for booting a car. If you are on private property, proper signs of the rules have been posted, and you break the rules, then they can boot. They can also give you a 'ticket' (technically it's compensation for a breach of contract or something silly; it's basically fluff you can ignore unless they've already nabbed your car).

Backstory: A friend of my wife is a foster mother, who is currently adopting one of the kids she fosters. The mother lost all parental rights last year. As far as anyone knows the birth mother has no idea who the foster mother is, and no one except the county social services should know both names. This is in California.

Story: Two days ago the foster mother began receiving phone calls from 1-800 numbers and a 1-877 number. They were asking for the birth mother by name (ie: 'I need to speak to Jane Doe' where Jane Doe is the birth mother.) She told them that that wasn't her, and they demanded to know her name. She refused to give it (a little freaked out understandably) and asked them who they were. They refused to say who they were until she gave her name so she hung up. She said it sounded like a collections agency, but is freaked out that it could be someone the birth mother knows trying to get information on where the kid is.

Is it legal for them to refuse to identify themselves before you identify? Is there any way she can make them stop without giving her name? Could someone actually be spoofing 800 and 877 numbers?
If they refuse to give their name and state their business then it's considered harassment and is illegal. She should keep a list of when they call and report the numbers.

Is there some kind of omnidirectional microphone that I can plug into my laptop to pickup a room full of speakers? I don't need this to be broadcast on C-Span, just good enough for someone on Skype or somesuch to hear, without having to hand the microphone around (which is rather disruptive).
They make phones specifically for conference calls. They look like triangular spaceships and you could probably pick one up for around $200.

 Well, that fixed the error message.
I think I have the solution. It's complicated as hell, but seems to give me the information I need.
code:
=IF( ISNUMBER( MATCH(A*,$A$2:$A$5986,0) ) ,1,0)
This returns 1 if the current value of column A exactly matches that of one of the threshold-exceeding values (which are now sorted to be the top 5985 rows below the header row). It returns 0 otherwise. (The "*" refers to the current row number.)
Did you mean:
=IF( ISNUMBER( MATCH(A*,$B$2:$B$5986,0) ) ,1,0)

So your A value has to match any B value over the a specific value? If that's the case you can use your if statement to return the A value (instead of 1), then filter the column to remove the 0's, and filter B to be above your value.

TheLastManStanding
Jan 14, 2008
Mash Buttons!
So there are duplicate A values and you want to keep all of them as long as one of their B values is above the threshold? If you use your current if statement you can still filter the rows in excel rather than exporting to awk and then back in: Select all the columns, filter, then uncheck 0 in the drop down box.

And another excel question, there seem to be some ridiculously good people in here for those. I copy a large batch of stuff from a economics program with both both text and numbers in a bunch of cells. Most of it is fine but some of the number cells are text instead of numbers, according to excel. If i type the number in manually it works fine.

An example is the number 10 468,24 which excel reads as text. If I remove the space from that and make it into 10468,24 it is read as a number. Is there a setting somewhere or something I'm missing that will make excel just read it as numbers from the start? I can just use Find and Replace to replace all spaces with nothing but I would prefer a solution over a workaround if there is one.
The final step of the import has an button for 'advanced text import settings' which allows you to define the decimal and thousands separator. Change the latter to a space and it will be able to recognize the number.

To extract the date you'll need a cell with
code:
=MID(CELL("filename"),SEARCH("_",CELL("filename"))-8, 8)
Then another which references it with
code:
=DATE(LEFT(A1,4),MID(A1,5,2),RIGHT(A1,2))
Where A1 replaced with whichever cell with the YYYYMMDD date is in
This assumes there aren't any underscores in your directories.

It could be as simple to fix your problems as changing the channel on your router to one with less interferences.

The farthest ends of rivers do dry up. The ground, however, is able to absorb a lot of water and release it slowly over time. Snow also stores a lot up water upstream. Then there are underground aquifers and springs. All of those combine over a huge area to keep large rivers flowing year round.

Yeah that confused me a bit and made me think that the equation must be for analyzing some kind of pipe or closed container where water can leak until the pressure equalizes, like if you covered the cup with an airtight seal. I don't really understand where the pressure differential comes from in an unsealed cup with a hole* because I have no background in physics and was mostly trying to be funny before I got curious.

Personally, I'd just drill a tiny hole in the bottom of the container and time a set amount of water emptying, then change the amount of liquid or size of the hole until it worked. It would be frustrating though because it would drain slower with small amounts of liquid and so the "experiment" wouldn't be scalable, right?

* I mean, I know the air pressure over the cup is changing as the water leaves and stuff, and there's pressure at the bottom of the cup because of the weight of the water, which is why it drains most quickly at first, it's just not particularly useful to me in this case.
It is an equation for analyzing a closed pipe with a constant flow, but you can still use it. You just set the first pressure to your head and the second pressure to zero. You can also set all those other coefficients to 1. Once you have the flow rate you just have to figure in the cross sectional area of your container and integrate everything over the height. This is a basic physics/fluid problem so there are plenty of videos on youtube which will explain it and give you the equations. In the example I linked it assumes a cylindrical container, but you can replace the pi*r^2 with whatever your cross-sectional area is (as long as it's constant along the height).

huh.. Not sure how I missed that. I guess I just assumed he was thinking of a traditional water clock. In that case it becomes a buoyancy problem. You'd still use Bernoulli's equation, but you'd have to calculate how the buoyant force changes as a function of height (it should be linear for a cylinder so you'd just need to know it's dry and sunk weight) and then use that to calculate your pressure difference. I don't believe it changes the equation much, but I'm clearly too tired to think.
