Fallom posted:

Why is the judge giving him endless chances to comply with an incredibly simple directive?

First Amendment concerns, coupled with it being a nonviolent crime. The case law on the constitutionality of gag orders is extremely light, as it's generally an accepted thing that defendants can talk as much as they generally want about stuff, even if they're being an idiot, unless they're deliberately trying to taint the jury pool.

For that reason, Stone originally got a very minor gag order from the judge *as a condition of his bail*. His lawyers can't say poo poo (easily in judge's rights) and Stone can't speak to the media on courthouse property (easily in judge's rights). He then did the instagram crosshairs post, causing the judge to impose a tighter gag order *as a condition of his bail*, as poo poo got much realer.

Basically, courts can't make defendants shut up about a case. The judge's way around that is to impose the gag order as a bail condition, which judges have a shitload of leeway on.

So Stone is continuing to gently caress up and breaking his *bail conditions*, so the judge is crossing t's and dotting i's before outright yanking Stone's bail. That would IMMEDIATELY get challenged on First Amendment grounds, so the judge wants this poo poo airtight.

Also white/rich. More a First Amendment thing though.

18 years was the guideline?

I thought below guideline sentences could be tossed and the defendant resentenced? Isn't that the "government overreach" that yallqaeda was "protesting" at the bird sanctuary?

Manafort's sentence came in light for a bunch of reasons:

- The sentencing guidelines aren't a mandatory minimum
- Mueller's team actually had no recommendation, just the sentencing guidelines
- Judge Ellis is notorious for coming in light for white-collar crime sentencing
- He badgered the special counsel's office a lot, likely because federal judgeships are the last true dictatorship and he can bloviate about whatever the gently caress, and be wrong, as much as he wants
- Manafort is white
- Similar cases on tax/bank fraud come in light, someone recently got only 6 months for a comparable thing
- The DC case is about the foreign lobbying and poo poo like that, this one was just the tax/bank poo poo

All of the above are contributions, so it's highly unlikely the sentence gets overturned or anything like that.

While I get the calculus behind this, it still sounds like "eh, gently caress it. Too hard! What can we do?"

To some extent, it's giving everyone involved election cover.

Moderates (idiots) are scared that impeachment proceedings will gently caress up their re-election path, a la Clinton impeachment.

Liberals want Trump out right now, but know impeachment is toast in the Senate. So, they get to yell about the lack of progress being Pelosi's fault. If they get asked why they're not introducing impeachment resolutions like they did last Congress, they just blame Pelosi some more.

Pelosi gets to shelve the issue and it's not like she cares about being a huge villain. She also dances the line between Moderates (idiots) and Liberals so the Democratic kitten herd is mostly kept held together. She also has a gigantic caveat in her statement if the Mueller Investigation changes anything.

Democratic Presidential Candidates win because they say anything they want about the subject, knowing that it's non-binding either way. They can take any of the above approaches and still have a solid "WE NEED TO BEAT THIS MOTHERFUCKER IN 2020, THAT'S THE SOLUTION" rallying cry.

Another one of those cases where the only fix was to not elect the idiot in the first place.
