But in say Fallujah where the majority of civilians have either evacuated or have picked up arms and are now combatants entire sections of the city were destroyed.

That’s one of the problems with arming your civilians - you’ve made the entire city a “legal” target. Take a pot shot from your apartment? Shot, over.

This is assuming calling actual war crimes as war crimes means more than wet paper. Because its entirely performative among disparate powers and you should assume nobody is going to play nice as soon as there is any sort of peer conflict, as we are currently seeing.

War crimes by the loser of a conflict are usually prosecuted. It’s the victor’s war crimes that are ignored.

For examples see the Nuremberg convictions related to invading Poland (USSR) and unrestricted submarine warfare (US).

Presumably if Wagner had the Bomb, Prig could say "Here's how it is, Putin, I and my secret friend in this big tank with a radiation sign on it say that Rostov is now the People's Republic of Wagneria and we will be glad to let you run troops through it to Ukraine in exchange for a piece of the action."

That seems like it could still happen but I mean, you want to try for Moscow first.

Wagner having nukes seem like something that would force Biden and Xi to get involved. Surely nobody could tolerate that?
