My aunt was telling me that her city got several million dollars from the state of California to build a state-of-the-art high school, and they got the whole thing built with plans to add on the gymnasium afterwards. Classes start, and a few weeks later they start preparing the space behind the school to build the gym, when they find there's a seam of serpentinite that runs underneath the whole thing. The whole school is closed down and has to be torn down and rebuilt somewhere else.

That kind of reminds me of the high school I went to. Its opening was delayed for several years because it was built a few miles from a toxic waste dump, and it earned the moniker "toxic high." The school district assured the community that there were no carcinogens in the soil, and they were probably right, and the district opened up the thoroughly failed attempt to open up a "global high school." (All of the signs were in the 9 most widely spoken world languages)

If I ever develop cancer I won't blame it on high school, however, I'll blame it on ROTC. My school conducted most activities at a nuclear waste dump Superfund site in the Midwest.

Dear MoveOn member,

This is Harvard Law Professor Lawrence Lessig.

Since the early 1920s, aviators and mariners have used the word MAYDAY to signal distress.

On the sea, when another captain hears that call, there is an obligation to lend aid.

At MayDay PAC, we are calling a MAYDAY on this democracy. Americans from across the political spectrum believe our government is broken. More than 90% of us link that failure to the role of money in politics.

And yet our politicians do nothing to break that link. Instead they spend endless time raising campaign funds from the tiniest fraction of the 1%.

Our democracy is held hostage by these funders of campaigns. We have announced a plan to get it back.

Learn more in this video, and please let me know if you're interested in being part of this.

Several years ago, I decided to give up my work on copyright and Internet policy and take up the fight against corruption.

I started collaborating with others on the best way to build a grassroots movement around campaign finance reform. Washington won't fix itself—the people need to take action.

That's why we created MayDay PAC, an ambitious "Super PAC to end all Super PACs" that will make reform a 2014 campaign issue. We've raised millions so far, shocking the political world.

Can you watch this video explaining MayDay PAC, and let us know if you'd be interested in supporting this effort?

With hope,

Lawrence Lessig

Note: Larry Lessig didn't pay us to send this email—we never rent or sell our list. We're helping build support for the MayDay SuperPAC because of MoveOn members' long involvement in fighting big money in our politics. After you watch Larry's video, you'll have a chance to support MoveOn as well as pledge to help launch MayDay.

Want to support our work? We're entirely funded by our 8 million members—no corporate contributions, no big checks from CEOs. And our tiny staff ensures that small contributions go a long way. Chip in here.

It's a contested area, legally. I generally view it with intense suspicion because when it's done for political purposes(like in this case) it's a pretty massive circumvention of Congress. Imagine a Republican administration that decides hate crimes and financial embezzlement are a low priority for Justice Department attention. Executive oversight of the administrative apparatus is an area that wasn't countenanced in the original design of the constitution, and while it's necessary to some degree it's also a real weak spot in US constitutional structure and jurisprudence.

Discendo Vox posted:

Depends on the source of the power asserted in the executive order. Some are beyond congressional scope- although more crucially, congressional override of an executive order, any executive order, is very difficult to achieve in the current political climate. When it can occur, it requires a lot of whipping and generates heavy press-which is why Presidents like to use them to bait the opposing party. That's a lovely use of a legal power meant for routine administrative affairs.

it's kind of funny to me that your legal views on executive power almost match john yoo's perfectly (when a democrat is in office).

Well i don't have to listen to any monk regardless of tradition but you know what i mean

this reminds me: one of my history teachers and decathlon coaches in high school was hella socialist and sponsor of our GSA and my parents are staunch republicans but then they learned he was vegan and he became my parents' favorite teacher. actually that story was not as entertaining as it sounded in my head, but it was amusing, to me, at the time

this nonchalant posting style is really hard

I'm just curious, but in Westminster what would you say the proportion of Catholics amongst Vietnamese-Americans in that community is? I ask because my fiance's entire extended global family comes from the tiny minority of Vietnamese Catholics. First I'm curious if Catholics made up a disproportionate part of the refugees. Second, because I only ever hear about or deal with Viets that come from a Catholic/filial piety/even more patriarchal family background, and I'm kinda curious what the familial politics are like in Buddhist families.

The Honorable Manuel Real is a good judge.

http://en.wikipedia.org/wiki/Manuel_Real

quote:

Real was noted for his judicial behavior in the 2000s. From 2001 to 2009, he had custody of disputed Filipino assets, which he had to account for in 2009. A federal appeals court panel then wrote "This curious statement plainly fails to account for all transactions involving the assets during the eight years they were held in the clerk of court's custody. It doesn't give the reader even a basic understanding of the path by which $33.8 million worth of assets deposited in September 2000 came to be worth $34.7 million today".

On January 11, 2012, the Ninth Circuit removed Real from the controversial case of Alexander Sanchez, a former M13 gang leader turned gang interventionist. His handling of this case has been compared to the judge in the infamous "Chicago Eight" trials by some commentators. Real has since been removed from other cases for behavior that threatened the fairness of the trials. In November 2012 it was reported that Real had shown a pattern over a number of years of making rulings in favor of companies in which he owned stock.

http://judgepedia.org/Manuel_Real

quote:

In 2009, there were calls for the 85 year-old Real to retire his seat on the federal bench, citing his high rate of appellate reversals and dictatorial manner in the courtroom. According to the Los Angeles Times: "Judiciary analysts have calculated that Real's reversal rate in some years has been as high as 10 times the average for federal district judges." However, judicial misconduct overview agencies have found his behavior to lack the "willfulness" required for formal sanctions.
