No. They just followed the law as it is currently written. I can tell you that due to this, the legislater are working to change the law to close the loophole. This happens all the time. I can think of a case where a guy got second degree mureder instead of first degree for beating his kid killing him, since he did not intend to kill the kid. The guy just wanted to beat him. The state then changed the law so that type of abuse would get 1st degree murder.

Also Deval Patrick just signed a law making it illegal.
